CBP issues and updates Section 232 Steel/Aluminum FAQ as guidance for the Trade (CBP) – 3/21

Of importance is the Country of Smelt/Cast for Aluminum and Country of Melt/Pour for Steel, when that country is unknown.

  • Customs guidance is that if unknown, a claim of Russia is to be made at time of entry for Importer to pay 200%​

  • Make sure you are discussing with your Supplier’s overseas for any impact and to have information provided prior to Customs entry.

Canada Hits US with more 25% Tariffs (STR) – 3/14

Canada has hiked tariffs on nearly C$30 billion worth of imports from the U.S. in retaliation for the Trump administration’s tariffs on steel and aluminum. 

According to a press release from Canada’s Department of Finance, as of 12:01 am on March 13 Canada imposed 25 percent reciprocal tariffs on C$12.6 billion worth of steel products, C$3 billion worth of aluminum products, and C$14.2 billion worth of additional goods imported from the U.S

Trade Regulations exempt from Notice and Comment, State Department Declares (STR) – 3/18

Federal authority over, and conduct of, customs- and trade-related rulemakings could be further muddied by a recent State Department notice.

By designating customs- and trade-related regulatory efforts as foreign affairs functions, Rubio’s notice thus appears to exempt such efforts from these statutory transparency requirements. This could mean that future rulemakings from U.S. Customs and Border Protection and other agencies that affect customs and trade could be issued, and take effect, with no warning to the trade community.

  • Brightening agents – continuation of AD duty orders on stilbenic optical brightening agents from China and Taiwan, effective Feb. 27

  • Hexamethylenetetramine – preliminary affirmative AD and CV determinations and new cash deposit requirements at rates of 2.32 to 139.55 percent (AD) and 420.53 percent (CV)

  • Pipe fittings – sunset review determination that revocation of AD duty order on malleable cast iron pipe fittings from China would be likely to lead to continuation or recurrence of dumping at margins up to 111.36 percent.

  • Pressure pipe – sunset review determinations that revocation of AD and CV duty orders on circular welded austenitic stainless pressure pipe from China would be likely to lead to continuation or recurrence of dumping at margins up to 55.21 percent and countervailable subsidies of 1.1 to 299.16 percent.
