U.S. Court Upholds Earlier Ruling Declaring Reciprocal And Fentanyl Imposed Tariffs Illegal

September 2, 2025

A U.S. Court recently agreed with an earlier court ruling that stated that the Trump Administration did not have the authority to impose reciprocal tariffs and tariffs against Canada, China, and Mexico for their alleged role in allowing fentanyl into the United States.

However, the court did find that the Trump Administration did have the legal authority to impose tariffs on aluminum, steel, and other products.

However, the court decided to allow the Trump Administration to keep assessing its reciprocal and fentanyl-imposed tariffs until October 14, 2025, as this will give the Trump Administration the opportunity to appeal the ruling to the U.S. Supreme Court.

This is a very fluid situation, and we will continue to provide updates as they become available.  In the meantime, if you have any questions about this or another tariff related issue, please contact our OEC Customs Brokerage Advisors here, or feel free to contact your designated OEC Customs Brokerage Advisor directly.

Thank you!
